This Copyright & Content Policy forms part of the Phonovia Terms of Use, Distribution Terms, and Anti-Fraud Policy. By using the Phonovia platform and services, you agree to comply with this policy.
For the purposes of this Policy, “Phonovia”, “we”, “us”, or “our” refers to Phonovia.
“User” refers to any individual or legal entity that uploads, submits, or distributes content through the Phonovia platform.
The purpose of this policy is to:
• ensure that only authorized content is distributed through Phonovia
• protect copyright holders and creators
• prevent infringement claims and platform penalties
• comply with Digital Service Provider (“DSP”) rules
• reduce legal and financial risk to Phonovia and its users
This policy must be read together with the Terms of Use, Distribution Terms, and Anti-Fraud Policy.
You may only upload content that you fully own or are legally authorized to distribute.
You must have all necessary rights for:
• sound recordings (master rights)
• musical compositions (publishing rights)
• lyrics
• samples
• beats and instrumentals
• artwork and images
• performer rights and permissions
If multiple people contributed to the work, you must have their written permission before uploading.
Phonovia does not verify ownership and relies entirely on your representations.
You may NOT upload or distribute:
• music you did not create or do not control
• purchased “type beats” without a distribution license
• beats licensed only for non-commercial use
• YouTube beats without a valid commercial license
• remakes, remasters, or altered versions of other artists’ recordings
• karaoke, cover, or instrumental versions without proper licensing
• DJ mixes or compilations containing third-party music
• copyrighted samples without clearance
• leaked or unreleased music belonging to other artists
• podcasts, audiobooks, or spoken content you do not own
Uploading content from free download websites or beat marketplaces without a commercial distribution license is strictly prohibited.
You may only distribute cover songs if you have obtained all legally required licenses in the territories where the music is distributed.
Phonovia does not obtain mechanical licenses on your behalf.
Any recognizable portion of another recording requires clearance from the copyright owner.
Pitching, slowing, reversing, or modifying a sample does not remove the requirement for permission.
If you use a beat created by another producer:
You must hold a valid commercial distribution license that allows:
• streaming
• downloads
• monetization
• DSP distribution
Exclusive licenses must still allow digital distribution.
If your license limits streams, platforms, or monetization, you may not upload the release.
Phonovia may request your license agreement at any time.
All release information must be accurate and not misleading.
You may not:
• impersonate another artist
• use a confusingly similar artist name
• use another artist’s artwork or branding
• credit yourself as a featured artist without permission
• upload under an existing famous artist profile
Metadata manipulation intended to gain streams is prohibited.
You may not upload:
• cloned voices of real artists
• AI vocals imitating identifiable performers
• deepfake music or impersonations
AI-assisted music is allowed only if it does not impersonate a real person and you hold all rights to the output.
Phonovia may remove or disable access to any content without notice if:
• a copyright claim is received
• a DSP requests removal
• ownership cannot be verified
• a rights holder dispute arises
Phonovia may forward your information to the claimant to resolve the dispute.
Repeat infringement may result in permanent account termination.
Phonovia may request proof of rights at any time, including:
• license agreements
• producer contracts
• collaborator permissions
• publishing confirmations
Failure to provide documentation may result in removal of content and withholding of royalties.
You are fully responsible for all legal and financial consequences of your uploads.
If your content causes:
• DSP penalties
• chargebacks
• copyright claims
• settlements
• legal costs
Phonovia may:
• withhold royalties
• offset future earnings
• recover losses from your account
You agree to indemnify and hold harmless Phonovia against all claims related to your content.
Accounts repeatedly violating this policy may be permanently banned.
All associated releases may be removed and royalties forfeited where required to resolve claims or platform penalties.
Phonovia reserves the right to review any submitted Release before distribution.
Phonovia may delay, refuse, or cancel distribution where necessary, including but not limited to:
• suspected copyright infringement
• missing or unclear licensing
• impersonation risks
• metadata manipulation
• suspected artificial streaming risk
• policy violations
• legal or contractual risks with DSPs or partners
Payment of service fees does not guarantee distribution.
Phonovia is not obligated to distribute any content that may expose the platform, partners, or DSPs to legal, financial, or contractual risk.
You authorize Phonovia to remove, disable, or request removal of any Release from DSPs at any time where reasonably necessary, including copyright claims, disputes, suspected fraud, partner requirements, or legal risk.
You acknowledge that removal may occur without prior notice.
Phonovia shall not be liable for any losses, missed revenue, or damages arising from such removal.
Royalties associated with infringing, disputed, or fraudulent content may be permanently withheld and may never become payable.
Such funds may be used to satisfy DSP claims, partner penalties, legal settlements, or reimbursement obligations.
Users have no entitlement to royalties connected to policy violations.
